406:"A elevação de 'Capela' a vila, se deu em 1833, pelo Presidente da Província, em conselho, na execução do Código de Processo Criminal. O Conselho Geral da Província, era uma espécie de poder legislativo. Tinha por principal objeto propor, discutir e deliberar sobre os negócios mais importantes da sua Província, formando projetos peculiares e acomodados às suas localidades e urgências (Constituição do Império, art. 81). O Objetivo da referida elevação foi para que a Capela pudesse gozar vantagens que só às Vilas eram conferidas. Dentre elas, enumeramos as seguintes: Criação da Comarca, criação do 1º tabelião público, judicial e notas, escrivão de órfãos, provedoria e anexos. (Constituição cit., art. 167). Assim, de fato e de direito, a elevação de Capela à Vila, data de 1833, época em que começou a desfrutar as prerrogativas asseguradas na lei. Não se venha com o argumento de que a elevação parte da aprovação do ato que lhe deu aquela categoria. A aprovação ou confirmação não era ato obrigatório da Assembléia.
