verschiedentlich declariret habe, daß ich auf dergleichen
Verbrechen die öffentliche Todesstrafe einestheils zu hart, anderntheils aber zu großem Scandale Gelegenheit gebend finde, so will ich auch, daß in gegenwärtigem Falle die Todesstrafe zur Festungsarbeit verwandelt werden soll. So abscheulich dieses Verbrechen an sich ist, so zeiget sich doch in den allermehresten Fällen, daß diejenige, von denen solches unternommen worden, gemeiniglich Leute sein, die so wenig einige Be griffe von der Religion , als von der Größe ihres horrenden Verbrechens informiret seind und daß also folche, sonder die Enormité ihres Verbrechens zu erkennen, ohne Sentiment ihrem brutalen Triebe gefolget haben. So ist ferner nicht zu leugnen, daß durch die publique und affreuse Todesbestrafung dergleichen Inquisiten, viele junge und ohnschuldige Gemüther, welche natürlicher Weije die Ursache einer so affreusen Erecution wissen wollen, dadurch, zumal wenn sie in gleicher Ignorance von Sentiments seind, mehr scandalisiret als gebessert und wohl gar böse Neigungen in ihnen erreizet werden, davon sie vorher keine Empfindung gehabt. Aus welchen Ursachen denn Mein Wille ist, daß auf dergleichen Verbrechen fünftighin auf die Todesstrafe erkannt, sondern vielmehr auf eine proportionirte Festungsarbeit gesprochen, zugleich aber alsdenn verfüget werden soll, daß ein Prediger dergleichen Leute besuchen, ihnen die Größe und Abscheulichkeit ihres begangenen Lasters begreifend machen und selbigen zugleich bessere und genugfame Begriffe von der Religion beizubringen sich alle Mühe geben soll. Ihr habt hiernach dem Criminal-Collegio jedoch nicht ver mittelst eines Edicts, sondern nur eines Rescripts zu instruiren, auch sonder demselben dieses Mein Schreiben zu communiciren oder aber wohl gar anderen davon Abschrift nehmen zu lassen ; maßen es Mich wohl nicht anders als mißfällig sein kann, wenn Ich vernehmen muß, wie bishero bei denen Kanzleien so ohnordentlich und unbehutsam verfahren worden, daß Meine Schreiben, nicht weniger Meine eigenhändige Resolutiones und Beischriften gleichfalls zum freien Kauf gestanden und jedermannen zum Abschreiben und Divulgiren communiciret worden. Welches von nun an bei schwerer Strafe durchaus nicht mehr geschehen und worauf das Officium Fisci zu vigiliren besonders angeleitet werden soll.
