  • Delete - Bad licence; copyright is owned by the Subway Restaurant Chain (or whoever owns them), it's not incidental, but central to image. Really isn't necessary for the article it's used in, no rationale and a valid one probably cannot be written. WilyD 12:07, 5 September 2008 (UTC)

  • archive photo that is supposedly PD-self, which I don't entirely understand. it's also not in use, so it doesn't seem terribly crucial. i say delete unless we have further confirmation that this is self-taken Calliopejen1 (talk) 06:35, 29 August 2008 (UTC)
  • Comment. From the nature of the image (taken out of the midst of the radical demonstrators), the editing profile of the uploader, and their user name ("Laokratia"), I understand they probably wished to imply they represent the organisation in question, so the "PD" might actually be correct. But since they haven't been active and the image was apparently never used, it's probably not worth waiting for an OTRS ticket. Fut.Perf. ☼ 13:39, 31 August 2008 (UTC)

    So you're both a facist and a communist? Interesting choice of ideologies, my friend. Anyway, I do hope that we can find a way to save this image, it's encyclopedic and well composed. It illustrates Protest march in a way that many of those images do not. With any luck, the OTRS certification will be timely and we can keep this one.   • We don't need to see this magazine cover to understand that those conjoined girls where featured on the cover. I believe the image is being used more as an illustration of the girls likeness (what would make this replaceable, since this is a drawing) and as an illustration of polycephaly (what can also be replaced my freely available material).   • We don't need to see this picture of grounded airplanes and camels to understand this article about the planes hijacking. Also, source information is missing. Damiens.rf 16:35, 29 August 2008 (UTC)
  • Keep but allow uploader to add rationale - if you read the caption it was part of the terrorists' press conference video showing the planes on the ground. It is some of the only footage of the hijacking. Yes, it needs a rationale, but we should assume good faith and allow the uploader to fix up the image. JRG (talk) 00:51, 2 September 2008 (UTC)
    • There's a rationale and it says "news image being used to describe a particular event", That happens to be an invalid rationale, but I agree with you there's no bad faith in writting a bad rationale or uploading and image against our policies.   • IMO this picture even qualifies for commons since, art. 32 of the Jordan law (see art. 10 of the amendment) says that images are protected for 25 years. The picture is definitely taken in Jordan and definitely in 1970 so it should be in the PD. --Matthiasb (talk) 12:42, 6 September 2008 (UTC)

  • Keep and note to closing nominator - the picture may well have been at the page linked, but the page is no longer available. Unless the nominator has concrete evidence that the photo is not public domain or can't be used for any purpose then this image should be kept in good faith. While I don't have the last archive of the page, this web archive from 2006 said the images that were up then can be used for any purposes. I note the page has been updated since then but the archives come up as blank. JRG (talk) 00:48, 2 September 2008 (UTC)

I read that broadly. There is no prohibition at all, and it just says that usages are allowed. As I said, the page was updated at least twice after that so we cannot tell the license. We must assume good faith and keep the image unless verifiable information is available to show it is not released into the public domain or kept for any purpose. I am going to contact Jim Turnour (or I will get Timeshift9 to do so) so we can confirm the license on the image.   • Picture (no, it's not a screenshot) copied from a news source, not used for commentary about the image itself (because it's not notable by itself), but for commentary about the important event captured on the image. Damiens.rf 17:09, 29 August 2008 (UTC)
  • Keep - the user did not notice that I have since uploaded a new picture free of any NFCC#2 issues and updated the image template - I uploaded this before I was aware of the proper template licensing issues and have now fixed it. The closing nominator should take note that the spurious nomination was based on the image's previous form and incomplete fair use rationale (which was adequate and fine at the time the image was originally uploaded, which was before the new rules came in at the end of 2006). The image is a valid non-free use which meets all NFCC criteria as far as I am aware. The nominator is citing policy that does not exist - there is no requirement that the image itself be notable in order to fulfil fair use/non-free criteria only that it add significantly to the article - which it does - It is an image of a non-reproducible significant historical event which occurred in a remote place inaccessible to the general public and of which there are no free images available. An accident is not simply describable by text - an image should be present to improve the article and show the aftermath of the accident (as described and referenced therein).   • Comment: Noting for the record that the original nomination was correctly argued and would have led to deletion, I also confirm that the replacement now uploaded seems to fit under {{Non-free copyright holder}} (fair use for non-commercial purposes endorsed by owner) and thus NFCC#2 is now passed. I'd then go for a weak keep. (Passing notice: It's interesting that the two photographs are almost identical and seem to have been taken by the same person from the exact same spot, probably only a few seconds apart. Could well be the case that the ultimate copyright status is identical for both.) Fut.Perf. ☼ 14:20, 31 August 2008 (UTC)
    • I asked the person voting keep to upload the government version of the image. I feel the press photo would not have worked, since the event was only a few years ago and could still be used to make money. This photo, from the government, was taken for the purpose to inform people and it is only unfree due to the Crown Copyright.   • Keep - meets all NFCC criteria. This is a non-reproducible historic and iconic image of the first TV news broadcast on the ABC ever, which is used to in the section of the article on the beginning of television broadcasts in Australia and is now sourced - and is extremely relevant for the understanding of the television station. The "news source" reason is not a reason for deletion as such - it's a source about replacing the commercial value of the image and given the ABC is Government-owned this is hardly relevant. Dibble I believe died earlier this year or last year, so it is definitely not replaceable. If the closing nominator thinks I or someone else can fix up the rationale, please tell me - but deleting a historic image like this for a spurious reason is not the way to go if we want to improve the encyclopedia.     • The main point of the nomination is not really the "news source" kind of image (WP:NFCC#2) since, as far as I understand, them image is not really being used to illustrate a news/historic fact. The point of the nominations is really WP:NFCC#8. For instance, could you elaborate on how looking to this still from the first TV news broadcast on the ABC ever can help us to understand the history of ABC? And in the article about James Dibble, the image is just serving our interests in illustrating an article about that person (what's the fair use here?) --Damiens.rf 15:12, 2 September 2008 (UTC)
      • Any idiot (except you) can see that such an image illusrates the history of the ABC. The ABC is a television station, so of course an image of the first broadcast is going to add to it. How on earth would it not? JRG (talk) 12:56, 4 September 2008 (UTC)
  • Keep - I do see that this passes WP:NFCC#8 (it increases my understanding at least). Really an iconic image in Australian television history showing the first news broadcast. I cannot see any way that this can be adequately replaced by text alone. A question on the copyright also as the image is over 50 years old; according to this I think the image became PD in 2006 - the specific text is "The rule for duration of copyright in a broadcast was 50 years from the end of the year the broadcast was made" Peripitus (Talk) 07:26, 2 September 2008 (UTC)
