The complaint of misconduct was made after Tairawhiti District Health (TDH), Nurse Roberts's then employer, were seriously embarrassed in a Labour Department hearing after Nurse Roberts had been accused of professional incompetence. Amongst other things TDH were ordered to pay compensation to Nurse Roberts; remove the accusation from her personal file; provide her with a factual reference and also ordered not to mention the allegation to future prospective employers. The accusation of incompetence was also false and malicious and was a racist act by another nurse at TDH. The New Zealand Herald ran a front page article about the matter.
