  • The FU rationale is given as "Illustration of the design section where costumes and bridge design is discussed", illustration is not valid under NFCC#8, only understanding is, the image is blurred and conveys little information on either costumes and bridge design, and is questionable if this topic was properly illustrated that it need to understand it would be significant enough to meet NFCC Fasach Nua (talk) 22:53, 15 April 2009 (UTC)

  • Keep because significance is already established by critical commentary in the article about the bridge's design. Such a design cannot be conveyed by descriptive text alone because it sets an unrealistic expectation for readers to imagine a science fiction setting that does not exist in anyone's familiar environment. Nominator's stringency is best applied to other non-free images on film articles that were inserted for decorative purposes and not supportive of existing critical commentary in the articles. —Erik (talk • contrib) 22:58, 18 April 2009 (UTC)
  • Weak keep assuming rationale is reworded. Things like the bridge redesign and costumes are valid reasons as subject of critical commentary. There's also a tad about lens flare throughout the film I saw that could be added. --Der Wohltemperierte Fuchs 00:25, 19 April 2009 (UTC)
  • Keep...but... This image has enough context and additional sources to warrant inclusion as an appropriate illustration of the paragraph in question. Given the impact of the subject in question within the Star Trek genre, I find this image to be appropriate to keep. That said, if there is another image (especially a free one...I know it is a serious longshot) that better shows the cinematography and set work of this movie, it could certainly be replaced. — BQZip01 —  02:29, 22 April 2009 (UTC)

  • Delete Unless a proper fair use rationale can be derived (another shot of the building could be taken, but if this is the logo of an organization, then it couldn't be recreated). Keep. I contest the deletion of the image under claims of WP:CSD#F7 both in form and substance. Disclaimer: i am the uploader.
In form: The file was speedy deleted two times, as it under WP:CSD#F7.1, but the deleting administrator is claiming that the deletion was motivated by WP:CSD#F7.2. The procedure for both causes differ, and User:hmwith resorted to the procedure specified for number 1 (inmediate deletion without notification) when he should have used the procedure established for number 2 (namely, tagging and notification for two days before deletion). I am the uploader and was not notified any of the times. I am not claiming that this was done in bad faith, as I understand that it is the nominator the one that should have notified me, but since there is a procedural vice in the previous deletions, i ask that this two previous deletions be not taken into consideration before making a decision on this nomination.
In substance: I dispute the claim that the file falls under WP:CSD#F7.1 (which was cited as the original reason for deletion), as the fair use rationale is not invalid per se: Chilean Law specifies that images of state officials in the exercise of their functions are free for use in educational contexts, even when the holder of property rigths over the image does not loose his rights in other contexts. Hence, even though the image does not enter the public domain (and is then in need of a fair use rationale) the use of the image in the context of WP is free, e.g. not requiring authorization. If attribution is needed is debatable (IANAL) but since the author is unknown to me (and i have exhausted the measures to identify him) this is not relevant.
I also dispute the more relevant question of whether the image is replaceable by a free alternative. Pinochet is, was, and always will be a military figure in the history of Chile. Presenting a photo of him in civilian suit is misleading, inconsistent with wikipedia use in other articles of similar figures, and plain wrong. He always wore military uniforms, even in his role as president of the republic. His official presidential portrait showed him in military uniform, his supporters usually prefer photos with military uniforms (see the galleries at www.fudacionpinochet.cl), etcetera. This leaves only one free alternative in commons: Augusto_Pinochet_-_1995.jpg (Augusto_Pinochet.jpg, Pinochet_y_Videla.jpg and Pinochet_y_Videla_2.jpg also show him in uniform but show him only incidentally), which I honestly believe to be of much inferior quality, both technically (it is overexposed, his face looks all funny and is plainly not well taken, and is of inferior resolution) and artistically (it is plain ugly, the colors are all wrong, etcetera), making it a non-valid free replacement. Of course, this is open to debate.
In addition to the above, this picture has a clear historical value, it is extremely famous in Chile and worldwide, and it has caused a lot of debate and controversies. It is probably the most famous and known photo of the Chilean dictatorship and of Pinochet, and given its historical value it is completely unique and representative of the repressive and iron-fisted nature of the Chilean dictatorship.   • WP:FAIR only allows fair use images where there is no free equivalent. It is patently obvious that Treasure Island (published 1882) has many free-use equivalents for a cover image, such as the Wyeth edition (America, 1911). Shoemaker's Holiday (talk) 06:18, 15 April 2009 (UTC)
  • DeleteKeep I find it highly doubtful that anyone has a copy of the 1882 or 1911 editions - which would satisfy the 95 years old rule - laying around to be used as free alternatives.     • The rules don't make exceptions for that. Otherwise, the plague of modern Penguin-edition covers we had for a while would never have been cleared up (anyway, I'm actually trying to get a Wyeth, and if I do, it's all going up on Wiki.   • Delete. Criterion 1 for use of a non-free image here is that the image must not be replaceable by a free image or text which exists or could reasonably be created.   • Leaning keep, with caveats I think it's at least somewhat justifiable to show the unusual graphic style of the film, if moved to the "Reception" section, where the graphic style is praised.   • Comment: I am inclined to delete because I do not believe it is easy to find critical commentary for a non-free image previously added for decorative purposes. Vice versa, it is easy; include commentary in the article, and if it helps to illustrate the commentary with a non-free image, do so.   • Leaning keep The commentary in the article listed by Erik shows there is potential for expansion. Furthermore, being able to identify the characters in the movie is appropriate for a cartoon.
